The real fight in America is going to happen over the Covid 19 Vaccination PART 2 by The Outlaw Micheal Tomsik


 I am writing this  PART 2 because I see many questions on SOCIAL MEDIA regarding the COVID 19 VACCINATIONS and LAWS regarding if an EMPLOYER can require you to have a VACCINATION as part of EMPLOYMENT or if a BUSINESS can ask you to VERIFY you had a VACCINATION.

BE READY AMERICA THE FIGHT HAS ALREADY STARTED!

Who knew over almost  a year would go by and a VIRUS would cause such devastation. The Covid 19 Virus has hit not only AMERICA but it has hit the entire WORLD!

I am posting this for you education and yes I researched all the information and it is based on what I found under Laws, Constitution, and our rights as Americans. I posted it because I see a lot of misleading information going around, so once again this has been researched!

CAN THE FEDERAL GOVERNMENT OR PRESIDENT MANDATE A VACCINATION FOR EVERYONE?

Currently the Federal Government and President does not have the authority to mandate a vaccination for all people. However they can mandate vaccinations for the Military, and for immigration reasons.

CAN STATES MANDATE A VACCINATION FOR EVERYONE?

YES in 1905 a case was brought to the Supreme Court after a Smallpox break out in Massachusetts and it was decided that STATES could mandate vaccinations. At this point in time NO STATE has made the vaccination a mandatory requirement but they do have the power to do it.

CAN AN EMPLOYER OR BUSINESS MANDATE A VACCINATION AS PART OF EMPLOYMENT?

Currently all the Covid 19 Virus vaccinations are under Emergency Use and this had made a very grey area in the laws regarding employers or a business requiring a vaccination as part of employment. However it is legal for an employer to ask if you have been vaccinated or not, and in some cases may be legal for the employer or business to require a vaccination.

Many people believe it is a HIPPA violation to ask about a vaccination but it is not protected under HIPPA Laws.

The bottom line is the answer is YES States and Employers or a Business may require as part of employment or to continue employment require a vaccination.

If and when the vaccinations are fully approved by the FDA you may see more places requiring the vaccination.

Recently in Colorado employers are allowed to require proof of the vaccination and require the vaccination as part of employment.

Recently in an article here in Missouri the question also came up with a YES answer. 

If an employer requires a vaccination you may be able to work with them if you have a disability related reason as to why you can not take the vaccination or if it falls under religious beliefs.

As in my other blog there are already hospitals, colleges, sports events, concerts, cruise lines that are requiring a vaccination as a employee, student, or customer.

As of May 2021 NO STATE has made the vaccination mandatory, and most all employers are still encouraging the vaccination but not making it mandatory.

CAN I BE ASKED IF I HAD A VACCINATION BY A BUSINESS?  

Many people thought HIPPA laws protected them against a business asking if you had been vaccinated or not. While many companies are avoiding the question to customers because it creates an environment of hostility. No one wants to share private medical information with some unknown person. 

Currently in AMERICA there are talks of VACCINATION PASSPORTS, or APPS ON THE PHONE that would show you had been vaccinated or not, Also more places are requiring some type of proof as in my last blog I pointed out.

Recently  I saw news that some foreign countries will require proof of vaccinations though this is actually pretty normal for traveling outside America.
